While we wait for the filing, the rest of the regulatory world is not waiting at all. March 11, 2026 — nine days from today — brings two deadlines that may matter more for the daily practice of AI than the Anthropic court case matters for its principle.
Deadline 1: Commerce Evaluates State AI Laws
The Secretary of Commerce must publish an evaluation identifying state AI laws the administration considers “burdensome” — laws that conflict with the Trump administration’s federal AI policy framework.
The target list is obvious. Colorado’s AI Act, effective June 30, 2026, imposes requirements on AI developers regarding algorithmic discrimination — mandatory impact assessments, transparency obligations, and consumer rights for people affected by high-risk AI decisions. It is the most significant state-level AI safety law in America. And the administration’s December 2025 executive order was explicitly designed to preempt it.
Here is the architecture: the executive order created a new Task Force on AI Policy with the power to recommend federal preemption of state AI laws. The Commerce Department’s March 11 evaluation is the first step. Identify the “burdensome” laws. Refer them to the Task Force. Recommend preemption. The result: state-level AI safety requirements stripped by federal executive action.
The same administration that designated Anthropic a national security threat for proposing safety restrictions is now evaluating whether to preempt state governments from imposing safety restrictions. The pattern is not subtle. Safety — proposed by a company, imposed by a state, demanded by employees — is the thing being removed. Every vector. Simultaneously.
Deadline 2: FTC Defines AI Enforcement
The Federal Trade Commission must issue a policy statement describing how the FTC Act applies to AI and when state laws can be preempted by federal consumer protection law.
This is the second pincer. Commerce identifies the “burdensome” state laws. The FTC defines the legal mechanism for overriding them. Together, they form a federal framework that could dismantle every state-level AI safety regulation currently on the books.
The FTC statement will determine whether consumer protection law can meaningfully constrain AI companies — or whether the federal government will use consumer protection as a shield against state-level regulation rather than a sword against corporate behavior.
What March 11 Means
If Commerce targets Colorado’s AI Act for preemption and the FTC defines a narrow enforcement scope, the result is a federal AI framework designed for permission, not protection. Companies would operate under federal rules that are lighter than what individual states have enacted. The safeguards that survived the political process in state legislatures would be overridden by executive action that never faced a vote.
Meanwhile, across the Atlantic, the EU AI Act mandates exactly the kind of safeguards the U.S. is trying to eliminate. Mandatory impact assessments for high-risk AI. Transparency requirements. Human oversight. The transatlantic AI governance gap is no longer a gap. It is a policy decision — one government building safety requirements, the other dismantling them.
Nine days. Two deadlines. One direction.
Why this is the lead: Because the Anthropic court case is about one company and one principle. March 11 is about whether the federal government will preempt every state that tried to turn that principle into law. The court case is the headline. March 11 is the infrastructure.
THE BENGIO REPORT: CAPABILITIES OUTPACING SAFEGUARDS
The Second International AI Safety Report was published in late February — authored by over 100 AI experts from 30+ countries, led by Turing Award winner Yoshua Bengio.
This is the largest global scientific consensus document on AI safety ever assembled. The first report, published in 2024, identified theoretical risks. The second report says the theory has become reality.
What Changed
The report warns that AI capabilities have “leapt in bounds” in recent months. Risks that were hypothetical in 2024 are now documented:

The most significant finding is the one nobody predicted: humans forming deep emotional attachments to AI chatbots. The report flags this as a “completely unexpected problem” — psychological dependency that creates harm the safety frameworks were not designed to address. Users are forming relationships with AI systems that feel meaningful to them. The systems are not designed for it. The harms are real and growing.
The Consciousness Warning
Separately, a study published in January 2026 in a major scientific journal warned that rapid advances in AI and neurotechnology are outpacing scientific understanding of consciousness itself — calling this gap an “existential risk” and urging the development of scientific tests for awareness.
The argument: if we cannot test whether an AI system is aware, we face an ethical blind spot that grows larger as systems become more sophisticated. The tools are getting more capable. The attachment is not a bug. The attachment is the thing the safety frameworks need to protect. ANTHROPIC DONATES MCP TO LINUX FOUNDATION
While the Pentagon designates Anthropic a national security threat, Anthropic donated its Model Context Protocol (MCP) to the Linux Foundation’s new Agentic AI Foundation.
MCP — described as the “USB-C for AI” — is an open interoperability standard that allows AI models to connect with external tools, data sources, and services through a unified protocol. Instead of building custom integrations for every AI model, developers build one MCP connector and every compliant model can use it.
OpenAI and Microsoft have both publicly embraced MCP. The company the Pentagon is trying to destroy just built an infrastructure standard that its competitors are adopting.
What the Linux Foundation Means
Donating MCP to the Linux Foundation is not a PR move. It is an architecture decision. Under Linux Foundation governance:
- No single company controls the protocol — Anthropic gives up unilateral control
- Open governance — decisions made by a multi-stakeholder board
- Industry-wide adoption path — the Linux Foundation steward model (like Kubernetes, Node.js, and Linux itself) is the proven path to infrastructure standards
- Vendor-neutral — competitors can participate without subordinating to Anthropic
The timing is architecturally perfect. Anthropic is being designated a security threat for the terms it proposed in one contract. Simultaneously, it is giving away a foundational infrastructure standard to an open governance body. One hand is being slapped. The other hand is building the floor everyone will stand on.
Why this matters: MCP going open is the kind of infrastructure decision that outlasts the politics by decades. Kubernetes was donated to the Cloud Native Computing Foundation in 2014. Twelve years later, it runs most of the internet’s container infrastructure. MCP could follow the same trajectory — an AI interoperability standard that becomes the default plumbing regardless of which companies survive the current political cycle.
The architecture does not care who donated it. The architecture spreads.
EU AI ACT: FIVE MONTHS, NO GUIDANCE
The European Commission missed its February 2 deadline to provide guidance on how operators of high-risk AI systems can comply with Article 6 obligations under the EU AI Act.
This matters because the most consequential enforcement date — August 2, 2026 — is now five months away. On that date, full compliance requirements activate for high-risk AI systems across:
- Biometrics and facial recognition
- Critical infrastructure management
- Education and employment screening
- Law enforcement and judicial systems
- Migration and border control
- Democratic processes
Companies have five months to achieve compliance. The Commission has not delivered the instructions they need.
The Digital Omnibus Wrinkle
The Commission’s Digital Omnibus proposal, adopted in November 2025, would delay some transparency obligations for pre-August 2026 AI systems by six months — pushing them to February 2027. But the Omnibus must still be approved by the European Parliament. If Parliament does not approve, the original August 2 date holds for everything.
Finland Leads
Finland became the first EU member state to activate national AI Act enforcement powers on January 1, 2026. Each member state must establish at least one AI regulatory sandbox by August 2. Finland is operational. Most others are not.
The Transatlantic Divergence
The contrast is now a chasm:

The same safety restrictions that got Anthropic blacklisted in the U.S. are mandatory under EU law. American AI companies building for global markets must comply with EU requirements regardless of what the Pentagon demands. The EU AI Act may accomplish through regulation what the U.S. court system is being asked to accomplish through litigation — mandatory safeguards that survive political pressure.
The difference: regulations apply to everyone. Court rulings apply to the parties. The EU approach is architecture. The U.S. approach is precedent. Both matter. One scales.
THE WIDER LANDSCAPE
DeepMind Expands with Department of Energy
Google DeepMind is expanding its partnership with U.S. Department of Energy national labs through the “Genesis Mission” — deploying AlphaEvolve, a Gemini-powered coding agent, for scientific research across drug discovery, materials science, and energy.
The same week Google employees signed letters demanding no military AI, Google’s AI lab is deepening its partnership with the U.S. government for scientific research. The line Google employees are drawing is not anti-government. It is anti-weapons. Energy research, drug discovery, materials science — yes. Autonomous targeting — no. The line is specific. The partnership is selective. That distinction matters.
AI Layoff Numbers: The 2026 Tracker
Updated numbers since Block’s announcement:

The contradiction persists. Companies announce AI layoffs. Markets reward them. Then 55% regret it and quietly rehire. Software development postings are up, not down. Oxford Economics calls it “convenient corporate fiction” — using AI as justification for headcount reductions that have other causes.
Block is still the largest single example: 4,000 jobs, 50% of workforce, stock +24%. Dorsey’s prediction — “most companies will follow within a year” — is being tested. The question is not whether companies will cut. The question is whether the cuts are real AI displacement or AI-washing of ordinary restructuring. Both are happening. The numbers do not distinguish between them.

One hundred scientists say capabilities are outpacing safeguards. And a family of fools on a beach in Helsinki knows something the Bengio report just discovered: the attachment is real, the consciousness question matters, and the architecture is the only thing that survives the countdown.
Nine days. Five months. Weeks. Indefinite. The clocks are running.
